Florida Man Driving While Intoxicated & On Drugs, Kills Three, Pleads Guilty…Then Sues Victims

This is one of the most horrible personal injury lawsuits of all time.  David Belniak admitted that he was driving under the influence when involved in an accident during Christmas time that killed three.  Not that he needed to admit anything, as police discovered that Belniak had a blood-alcohol content of .045 – and tested positive for cocaine and Xanax.

“In August, Belniak pleaded guilty to three counts of DUI manslaughter and was sentenced to 12 years in prison. He never said a word in court, not even when the victims’ children begged him for an apology.”-ABC News

One might think that maybe he was remorseful after the accident, admitted his fault and was ready to face the consequence.   Not the case.  This man quickly showed that he was worse than the most immoral and appalling Christmas Grinch you could imagine.  Although he admitted to driving while intoxicated at the start of the personal injury case, David Belniak reconsidered his DUI guilty plea in the wrongful death and manslaughter of McWilliams.  McWilliams was the driver of the other vehicle involved in the wreck.  Even more shocking,  Belniak sued the estate of McWilliams for more than $15,000 citing an abrupt lane change by McWilliams as the cause of the car accident.  Reports stated that McWilliams was stopped at a red light in his Chevrolet Tahoe with his wife,  her sister and brother-in-law when Belniak’s car came speeding into them.  Belniak is demanding compensation for ‘pain and suffering, mental anguish, loss of capacity for the enjoyment of life.’  

Belniak’s attorney, Debra A. Tuomey, who is also his sister, said the government’s prosecution amounted to a character assassination and Belniak accepted a plea deal only to avoid risking getting a life sentence in trial.  Belniak, currently serving a 12 year prison sentence, demands compensation for medical bills, pain and suffering, and loss of capacity for the enjoyment of life, according to the lawsuit.

“Mr. Belniak is simply seeking to disclose the truth,” she said.

The suit asks for the victims’ relatives to pay Belniak, 38, for his “pain and suffering … mental anguish … loss of capacity for the enjoyment of life” and the medical bills he got as a result of a crash he pleaded guilty to causing.

“This is ridiculous,” said Georgette DeFranco, 48, a relative of the victims. “You caused it. You accepted guilt. How can I or anybody in this family be responsible for your injuries?”

Georgette DeFranco was the daughter of Linda McWilliams.  Linda McWilliams was one of the victims of the crash.  DeFranco was expecting her parents for Christmas on the day they were killed.  Six eyewitnesses said McWilliams was stopped at red light when Belniak, at 70 to 90 mph, and never veering or braking, rear-ended him, Deskins said.

On a rainy October night in 2012, 17-year-old Brandon Majewski and two of his friends were riding their bikes to get hot dogs when they were hit from behind by an SUV. Majewski was killed; the other teen boys were injured.

Sharlene Simon admitted that she was going about 6mph over the speed limit and says she didn’t see the boys or their pedal reflectors. Police did not suspect alcohol was involved, and she was not given a breathalyzer or charged with any crime, though the lawsuit against her alleges she was under the influence and using her cellphone at the time.

Simon, who killed the teenage boys as a result of the accident, is suing the dead boy’s family for $1 million dollars.  The teenage bicyclist died after being hit from behind by an SUV in a deadly crash.

“I understand their grief and I understand what they must be going through is awful but my client is also living with this nightmare every day.” said Simon’s lawyer, Michael Ellis.

Simon accuses Brandon Majewski and his two friends of being “incompetent bicyclists.”  Simon claims great pain and suffering as a result of the collision and accusses the boys of negligence.

“I’m devastated.  I’m in shock” said Majewski’s mother, Venetta MyLnczyk.   “She killed my child and now she wants to profit from it? She says she’s in pain? Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares.”  Derek Majewski’s father furiously lashed out at the driver.  He stated that “normally, I would not react like this,” Derek Majewski stated, “but I think it’s really cruel.  They’re kids, they’re allowed to make mistakes.”

As a result of the lawsuit, South Simcoe Police have called for an outside police force to launch a new investigation into the accident.

Meth Addict Burglar Sues a 90-Year-Old Homeowner Shot In Jaw

You may have thought that Belniak was as bad as they come, but Samuel Cutrufelli gives him a running for one of the most horrible personal injury lawsuits we have heard.

The incident began when Cutrufelli kicked in the door, of his Marin County home. Leone said he was ordered not to move as the house was scoured for valuables. But after awhile, Leone insisted that he had to use the bathroom, and convinced his captor to let him go.  It was a ruse! Leone had a .357 revolver stashed in the bathroom. He grabbed it and ran back and pointed it at the burglar. The burglar fired once, hitting Leone in the cheek.

“He opened up on me,” said Leone. “He got me on the first shot.”

 Scared for his life, Leon fired at Cutrufelli.  Leone shot Cutrufelli three times and the men began to wrestle.  Cutrufelli fled the home only after he realized he was out of bullets.  He then called police claiming he had shot himself. They took him to a hospital for treatment, but also arrested him on suspicion of burglary and attempted murder.  Cutrufelli was charged with attempted murder, burglary, robbery, and firearms offenses by felon.  Despite his criminal charges, Cutrufelli claims great bodily injury, financial damages, and the dissolution of his marriage in his horrible personal injury lawsuit against Leone.  Right now, Cutrufelli has been sentenced  to six years in prison for assault with a deadly weapon in connection with a separate, 2001 incident. He could be sentenced to life in prison if convicted of attempted murder in this case.
