Tim McGraw’s Fan Threatens Concert Personal Injury Lawsuit After Being Slapped by Country Singer During Atlanta Concert
Tim McGraw has been under the microscope since video of him slapping a female fan lit up the internet earlier this month. Now Jesslyn Taylor, the victimized fan, is threatening to slap Mcgraw back…with a country concert personal injury lawsuit.
Country music superstar Tim McGraw was performing at Aaron’s Amphitheatre at Lakewood in Atlanta, Georgia was the incident took place. The “slap” occurred during the concert’s encore when McGraw walked down a catwalk while performing his 2013 single “Truck Yeah.” In video footage posted online earlier this month, McGraw is seen slapping hands with fans before the woman made contact with McGraw’s leg. He hit her in response. She tore his jeans and was later ejected from the show.
Before Jesslyn Taylor threatened to file the concert personal injury lawsuit, a representative for the singer explained the highly publicized incident to Billboard:
“At the end of the night during the encore, Tim was singing out in the audience and someone firmly grabbed onto his leg and wouldn’t let go as he was moving through the crowd. He instinctively swatted to try and keep them from ripping his jeans (which they succeeded at doing!), and so he could get to more fans who were trying to slap hands with him before the end of the show. He didn’t know who had grabbed him and was simply trying to keep his pants from being torn.”
Afterwards, McGraw appears visibly shaken and angry, and a security guard escorts the fan away from the stage area.
Giovanni Rosania, a criminal defense attorney based in Long Island, New York, did not believe that the country star will get in criminal trouble for what he did.
“Since she initiated contact, he probably wouldn’t be charged for a crime,” he said. “Is it proper self-defense? I don’t think so. It would need to be reasonable under the circumstances, and he’d need to be in imminent danger. … Any time you put your hands on someone, there could be civil recourse, especially if there are injuries. Is it a great case? I don’t think so.”
Even though he may not be held criminally responsible, Taylor hired a personal injury lawyer, and it appears like Taylor feels McGraw should be held civilly responsible.
The female fan’s newly hired concert personal injury lawsuit lawyer, Eric Hertz, stated that Taylor feels “humiliated” after the incident and wants an apology from the country star. Her lawyer added that she was not trying to harm McGraw when she touched his leg during the show. He adds that the show had an “interactive environment” that she was responding to. Mr. Hertz also stated that further legal action, including a concert personal injury lawsuit, may be taken.
Jesslyn Taylor and concert personal injury lawsuit attorney Eric Hertz feel that Tim McGraw acted too aggressively. Taylor feels that at the least she deserves a public apology. Hertz says his client is furious that Tim McGraw is “slinging mud” and publicly humiliating her.
It will be very interesting if Jesslyn Taylor does move forward with the concert personal injury lawsuit, as many blame her for the incident. Even Police sources at Atlanta Police Department said the woman could be seen as the aggressor and Tim was making a ‘common reaction’ to possibly being grabbed in the crotch by her.
The concert personal injury lawsuit has not been filed, but Mr. Hertz has contacted McGraw’s legal team on the matter. If settlement or an agreement is reached, it will likely not head to court.
