Philadelphia Negligence Lawyers

Fox Law Philadelphia Negligence Lawyers pursue negligence lawsuits when a person causes harm to another as a result of their negligence and may be held responsible for the damages caused by their negligence.  Damages are typically a monetary compensation, to be paid to the person for their loss or injury. Compensation may include reimbursement for work loss and injury loss.

What is Negligence?

Negligence is when a defendant had a duty to the plaintiff, the defendant breached that duty, and the breach was either a cause-in-fact or a proximate cause to the damages incurred by the plaintiff.  In order to distinguish between negligence and intentional torts, the state of mind during the conduct must be willful, wanton, and reckless.  It is also usually defined as consisting of a deliberate and conscious disregard for a known high degree of probability of harm to another.

What is Pennsylvania's Modified 51% Comparative Negligence Law?

Each state either rules by Contributory Negligence, or Comparative Negligence.  Pennsylvania is a Comparative Negligence Jurisdiction, which is plaintiff friendly.  Comparative Negligence means that a plaintiff can be up to 50% responsible for an accident and still collect damages in a Pennsylvania personal injury claim. If a plaintiff is more than 50% responsible for an accident, the plaintiff is not able to recover compensation for his or her accident expenses. This is because Pennsylvania follows the modified comparative negligence – 51% rule.

What does this mean for your case?

Even if you are partially at fault in an accident where you suffered injuries, you can still recover for your injuries.
